Terms and Conditions

1. Purpose

These Terms and Conditions govern the contractual relationship between:

  • Noche, publisher of the Noche mobile application, hereinafter referred to as "Noche" or "we"
  • Any individual or legal entity using the Noche application, hereinafter referred to as "the User" or "you"

These Terms apply to all services offered through the Noche application, including:

  • Table reservations at partner venues
  • Purchase of bar passes (prepaid drinks)
  • Drink orders at the bar
  • Event entry passes

2. Acceptance of Terms

Using the Noche application implies full acceptance of these Terms. By creating an account or making a reservation, you acknowledge that you have read and accepted these conditions.

Noche reserves the right to modify these Terms at any time. Users will be notified of any significant changes via in-app notification.

3. Services Offered

3.1 Table Reservations

The application allows you to reserve tables at partner clubs and bars. Each reservation is subject to the specific conditions of the venue (minimum spend, dress code, etc.).

3.2 Bar Passes

Bar passes are prepaid credits that can be used to order drinks at partner venues. They are:

  • Non-refundable once purchased
  • Valid according to the conditions defined at purchase
  • Only usable at the venue for which they were purchased

3.3 Drink Orders

Orders placed through the application are processed by the partner venue. Noche acts as a technical intermediary.

4. Prices and Payment

Prices displayed in the application are shown in euros (EUR) or Swiss francs (CHF) depending on your location, including all taxes.

Payment is made through our secure payment provider SwissPayout. Accepted payment methods include:

  • Bank cards (Visa, Mastercard)
  • TWINT (Switzerland)
  • Apple Pay / Google Pay

The transaction is considered complete upon payment confirmation by our provider.

5. Cancellation and Refund Policy

5.1 Table Reservations

  • Free cancellation up to 24 hours before the reservation date
  • Cancellation between 24h and 2h before: 50% refund
  • Cancellation less than 2h before or no-show: no refund

5.2 Bar Passes and Entry Passes

Bar passes and entry passes are non-refundable except:

  • In case of event cancellation by the venue
  • In case of venue closure

5.3 Refund Procedure

Refunds are made to the original payment method within 5 to 10 business days.

6. User Obligations

The user agrees to:

  • Provide accurate information during registration
  • Be of legal age (18 or the legal age in their country of residence)
  • Respect the rules of partner venues
  • Not use the application for illegal purposes
  • Maintain the confidentiality of their login credentials

7. Liability

Noche acts as an intermediary between users and partner venues. As such:

  • Noche is not responsible for the quality of services provided by venues
  • Noche cannot be held liable for indirect damages related to the use of the application
  • Venues are solely responsible for compliance with applicable regulations (license, hygiene, safety)

9. Intellectual Property

All elements of the Noche application (logo, design, texts, images, features) are protected by intellectual property law. Any unauthorized reproduction is prohibited.

10. Applicable Law and Disputes

These Terms are governed by Swiss law. In case of dispute, the parties agree to seek an amicable solution. Failing that, the courts of the Canton of Geneva shall have sole jurisdiction.
